HILLTOWN TOWNSHIP BOARD OF SUPERVISORS

REGULARY SCHEDULED MEETING

MONDAY, OCTOBER 8, 2018

The regularly scheduled meeting of the Hilltown Township Board of Supervisors was called to order by Chairman John B. McIlhinney at 7:08 PM and opened with the Pledge of Allegiance. Also in attendance were Vice-Chairman Kenneth Bennington, Supervisor James Groff, Township Manager Lorraine Leslie, Lt. Detective Randall Tanghe, and Township Solicitor Stephen Harris.

1. ANNOUNCEMENTS: Chairman McIlhinney stated there was an executive session prior to the meeting to discuss pending legal matters.

2. PUBLIC COMMENT ON AGENDA ITEMS ONLY: None.

3. CONSENT AGENDA:

a) Minutes of the September 24, 2018 BOS Meeting

b) Financial Report – September 30, 2018

c) Bills List – October 9, 2018

Motion was made by Supervisor Bennington, seconded by Supervisor Groff and carried unanimously to accept and approve items a) through c) on the Consent Agenda. There was no public comment.

4. CONFIRMED APPOINTMENT: None.

5. LEGAL:

a) Authorization to Advertise the Amendment to the Regulations for Yard Waste Ordinance No. 2018-003 – Solicitor Harris stated an amendment was prepared in regards to the regulations for the yard waste drop off area due to people abusing the facility. The ordinance defines what is permitted and prohibited at the yard waste drop off area and only for individual township residents and not for commercial businesses or businesses that are working for local residents. Motion was made by Supervisor Bennington, seconded by Supervisor Groff and carried unanimously to authorize the advertisement of Ordinance No. 2018-003 - Amendment to the Regulations for Yard Waste Ordinance with adoption on October 22, 2018. There was no public comment.

b) Hidden Meadows (Bethel Tract) Plans for Signature from the BOS – Solicitor Harris stated the Hidden Meadows (formally the Bethel Tract) final plans have been reviewed and approved by

the Township Engineer’s office along with all of the supporting documentation has been property executed. Motion was made by Supervisor Bennington, seconded by Supervisor Groff and carried unanimously to authorize the execution and recording of the final plans for Hidden Meadows (formally the Bethel Tract). There was no public comment.

6. PLANNING: None.

7. ENGINEERING: None.

8. UNFINISHED BUSINESS: None.

9. NEW BUSINESS:

a) Scott Drumbore – H&K – Requesting for extension of hours for November for the

Concrete and Asphalt Plant at the Skunkhollow Quarry – Township Manager, Lorraine Leslie, stated H&K has requested to operate the concrete batch plant, asphalt batch plant, and the crushing plant between the hours of 6:30 pm to 6:30 am, Monday through Saturday, between November 1, 2018 and November 30, 2018, excluding holidays, for the PennDOT projects per their letter dated October 3, 2018. Motion was made by Supervisor Groff, and seconded by Chairman McIlhinney, to grant the extension of hours for the month of November for the Concrete and Asphalt Plant at the Skunkhollow Quarry per their letter dated October 3, 2018 with the exception of striking the part in the letter in regards to "and/or private customers." The motion passed 2-1 with Supervisor Bennington having the opposing vote. There was no public comment.

b) Jim & Dina Bennett – 317 Victoria Lane - Fence – Mr. Jim Bennett stated he is requesting permission to place a removable aluminum fence with two gates within the easement area on their property to keep his dog in the yard, other dogs out of their yard along with other people. The location of the fence was specified. Solicitor Harris stated there is a standard agreement to be executed before the fence is placed. As a side note, Solicitor Harris stated Mrs. Miletto, from a prior fence request, will be putting up $500,000.00 insurance. Motion was made by Supervisor Bennington, seconded by Supervisor Groff and carried unanimously to approve the removable fence for the property owned by Jim & Dina Bennett at 317 Victoria Lane in accordance with the standard agreement. There was no public comment.

10. SUPERVISOR’S COMMENTS: Supervisor Bennington, as a veteran himself, wished his fellow Veterans a thank you for their service and he appreciates the day. Chairman McIlhinney and Supervisor Groff thanked Supervisor Bennington for his service.

11. PUBLIC COMMENT: John Pascavage, 217 Frontier Road, discussed his concerns regarding the proposed Wawa at Route 113 and Route 313.

12. PRESS CONFERENCE: None.

13. ADJOURNMENT: Upon motion by Supervisor Bennington, seconded by Supervisor Groff and carried unanimously, the October 8, 2018 Hilltown Township Board of Supervisors meeting was adjourned at 7:32 PM.
