Board of Supervisor’s Decision In Re: Garlan Properties, LP

HILLTOWN TOWNSHIP, PA, June 10, 2024 – On May 20, 2024, the Hilltown Township Zoning Hearing Board issued a Decision and Order (the “Decision”) granting certain zoning relief to Garlan Properties, LP.

After thoroughly reviewing the Decision and resident feedback, and consulting with legal counsel about the evidence and testimony presented at the hearing and rules of law relating to an appeal, the Board of Supervisors (the "Board") has decided not to appeal the Decision to the Court of Common Pleas.

While the Board may disagree with the Zoning Hearing Board’s findings and conclusions, it does not believe the Decision is likely to be overturned on appeal.

It’s important to note that an appeal to the Court of Common Pleas would not involve a complete retrial of the case. There would not be a second presentation of evidence and testimony. Instead, deference is given to the Zoning Hearing Board’s decision, and the review is limited to the record and briefs submitted by the parties to determine whether the Zoning Hearing Board abused its discretion or committed an error of law. Given this limited standard of review, the Board does not believe that a reversal is likely.
